NOTICE TO BIDDERS

Sealed bids, subject to the conditions contained herein, will be accepted by the Warren County Financial Management Committee at the Warren County Administrative Building, Office of the Finance Department, 201 Locust Street, Suite 2, McMinnville, Tennessee, 37110, up to but no later than 2:00 PM Central Time on Thursday, October 25, 2018 and then publicly opened and read for security upgrades for the Warren County School System.

No bids may be sent via e-mail or fax. Bidders shall enclose two (2) copies of the bid and note the bid submitted (i.e. Security Upgrades Bid) on the outside of both the shipping envelope (FedEx, UPS, etc.) and the sealed bid envelope contained inside or the bid will not be opened.

Copies of this bid are on file and may be obtained at the Warren County School’s Administrative Offices or by accessing the website at www.warrenschools.com  or www.warrencountytn.gov and clicking the link for current bids.

Employees of the selected contractor must have a sexual predator background check performed prior to entering any Warren County school grounds as per Tennessee Code Annotated Section 49-5-413.

The Warren County Financial Management Committee reserves the right to accept or reject any or all bids, to accept or reject any item thereon, to waive any irregularities in the bid or bidding and/or to abandon or postpone this project without any obligation to bidders. The Warren County Financial Management Committee will act as sole judge of the merit and qualifications of vendors and materials offered and accept whatever bid deemed to be in the best interest of Warren County. No bidder may withdraw their bid for a period of sixty (60) days after date set for opening of bids. The Financial Management Committee reserves the right to increase or decrease quantities.

In case of tie bids, Warren County, Tennessee reserves the right to negotiate with bidders.

By submission of this bid, the vendor agrees to all terms and condition stated therein.

Bids will be awarded accordingly as prescribed by law, which states "lowest and best." A Supreme Court ruling states that the discerning of best lies solely on those requesting the bid and not the bidder. No bidder may withdraw their bid for a period of sixty (60) days after date set of opening of the bids.

Section 00 11 13 Advertisement for Bid

OWNER:         Warren County Finance Department, on behalf of

Warren County Schools, McMinnville, Tennessee

Sealed bids for will be received by Justen Cotten, Finance Director, at his office located at 201 Locust Street, Suite 2, McMinnville, TN 37110, for the Warren County Schools Security Upgrades.  Bids will be received until 2:00 PM Central, Thursday, October 25th, 2018, at which time the bids will be opened and publicly read aloud;

A Pre-Bid Conference for all project sites will be held at 9:00 am, Central Time, Tuesday, October 16th, 2018 starting at Dibrell Elementary, 1759 Mike Muncey Rd, McMinnville, TN 37110, beginning at the canopy on the north side of the building.  Bidders should plan to have a representative present.  Attendance is not mandatory but is strongly encouraged.  Bidders will have the opportunity to visit all the project sites.

Prospective Bidders / Contractors may obtain electronic access to the Bid Documents by contacting the Architect, at 362 Industrial Blvd., Crossville, TN 38555; phone (931) 484-7541, for a $50 non-refundable plans deposit.  Addenda will only be issued to Bidders / General Contractors who have registered with the Architect.

Each bid must be accompanied by a bidder's bond executed by the bidder and a surety company licensed to do business in the State of Tennessee, for the sum of five percent (5%) of the amount bid.  In-lieu-of a bid bond a cashier's check in the amount of 5% of the bid amount, made payable to the Owner, will be accepted.  The successful bidder will be required to execute an AIA A312 Performance Bond in the amount of One Hundred (100%) of the contract price, or other security such as letter of credit as described in Tennessee Code Annotated 12-4-201, for 25% of the contract sum.  Bonds must be accompanied by Power of Attorney.

No bid may be withdrawn for a period of thirty (30) days after the date set for the opening bid.

All bidders must be licensed contractors as required by Chapter 135 of Public Acts of 1945 of the General Assembly of the State of Tennessee, Section 1.  Bidder's name and license number must be placed on the envelope containing his bid and bond.

The Owner reserves the right to reject any or all bids and waive informalities therein.

The Bid Envelope Cover Sheet must be completely filled out.  Any bids received with Bid Envelope Cover Sheet omissions will be returned to the bidder unopened.

Any Bids received after the scheduled closing time for the receipt of bids will be returned unopened.

TIME FOR COMPLETION:

It is hereby understood and mutually agreed by and between the Contractor and the Owner that the date of beginning and the time for completion of the work to be done hereunder are essential conditions of the contract; and it is further mutually understood and agreed that the work embraced in this contract shall be commenced immediately upon notice to proceed and shall be completed within 125 days, with intermediate dates for portions of the work, as described in the documents.

The Contractor agrees that said work shall be executed regularly, diligently, and uninterruptedly at such rate of progress as will ensure full completion thereof within the time specified.  It is expressly understood and agreed by and between the Contractor and the Owner that the time for completion of the work described herein is a reasonable time for completion of the same, taking into consideration the average climatic range and usual industrial conditions prevailing in this locality.

If the Contractor shall neglect, fail or refuse to complete the per project schedule or any proper extension thereof granted by the Owner pursuant to AIA Document A201, the Contractor shall be liable for all such actual damages sustained by the Owner as the result of each delay, except that when such actual damages may be difficult to ascertain, the Contractor shall pay liquidated damages of $200.00 / day.

For each and every calendar day that the Contractor shall be in default after the time stipulated for completion of the work.  In no event shall such payment be construed as a penalty but shall be considered as reimbursement for the Owner's additional expense and loss occasioned by unexpected Contractor's delay.

Delays occasioned by strike occurring on the job during the performance of the work, riots, civil commotions, change orders, and such other justifiable delay as may be approved by the Owner and the Architect pursuant to the provisions of the General Conditions, shall be the only exceptions for which a request for excusable cause shall be made in writing to the Owner no more than 21 days after the delay begins.  Otherwise such claim shall be waived, and the work shall be completed without extension for such delay.
