NOTICE TO BIDDERS

Sealed bids, subject to the conditions contained herein, will be accepted by the Warren County Financial Management Committee at the Warren County Administrative Building, Office of the Finance Department, 201 Locust Street, Suite 2, McMinnville, TN 37110 up to but no later than 11:30 AM Central Time, Wednesday, April 21st, 2021, and at this time publicly opened and read for the Warren County Middle School Window Replacement Project for the Warren County School System.

No bids may be sent via e-mail or fax. Bidders shall enclose two (2) copies of the bid and note the bid submitted (i.e. Warren County Middle School Window Replacement Project) on the outside of any shipping envelope (FedEx, UPS, etc.) if the bid envelope is contained inside.

A Pre-bid meeting will be held at Warren County Middle School at 10:00 AM Central Time on Friday, April 9th, 2021.  The purpose of this meeting is to explain the scope of work and to provide an opportunity for bidders to ask questions about the project.  Bids received from Bidders not in attendance will not be opened.  Bidders may also visit the site after 3:00 PM on Tuesday, April 13th and Wednesday, April 14th to gather information required to prepare their bid.  

The information for Bidders, Form of Bid, Form of Contract, Plans, Specifications, and Forms of Performance and Payment Bond, and other contract documents may be examined at the following:

Prospective Bidders / Contractors may obtain electronic access to the Bid Documents upon request from the Architect, at 362 Industrial Blvd., Crossville, TN 38555; phone (931) 484-7541.   Addenda will only be issued to Bidders / Contractors who have registered with the Architect.  

Each bid must be accompanied by a bidder's bond executed by the bidder and a surety company licensed to do business in the State of Tennessee, for the sum of five percent (5%) of the amount bid.  In-lieu-of a bid bond a cashier's check in the amount of 5% of the bid amount, made payable to the Owner, will be accepted.  The successful bidder will be required to execute a Performance Bond in the amount of One Hundred Percent (100%) of the contract price or other security as described in Tennessee Code Annotated 12-4-201, for 25% of the contract sum.  Bonds must be accompanied by Power of Attorney.

All bidders must be licensed Contractors as required by Chapter 135 Public Acts of 1945 of the General Assembly of the State of Tennessee, Section 1.  Bidder's name and license number must be placed on the envelope containing his bid and bond.

In compliance with Tennessee Code Annotated 50-9-113, employers with five or more 
Employees are required to submit an affidavit, which states that they have a “Drug Free Workplace Program” that complies with TCA Title 50 Chapter 9 in effect at the time of bid submission.  The successful bidder will submit such affidavit prior to signing contract.

Employees of the selected contractor must have a sexual predator background check performed prior to entering any Warren County school grounds as per Tennessee Code Annotated Section 49-5-413.

Bids will be awarded accordingly as prescribed by law, which states "lowest and best." A Supreme Court ruling states that the discerning of best lies solely on those requesting the bid and not the bidder. No bidder may withdraw their bid for a period of sixty (60) days after date set of opening of the bids.

Pursuant to T.C.A. § 50-9-114, Warren County, Tennessee has adopted a Drug & Alcohol Testing Program and is required to include this information in our bid specifications.  Warren County, Tennessee requires Alcohol and Controlled Substances testing for Safety-Sensitive Positions as required by the Federal Omnibus Transportation Employee Act of 1991 and related United States Department of Transportation rules and regulations set forth in 49 CFR Federal Regulations Parts 40 and 382.  BIDDERS MUST SUBMIT AN AFFIDAVIT THAT THE BIDDER OPERATES A DRUG AND ALCOHOL TESTING PROGRAM WITH REQUIREMENTS AT LEAST AS STRINGENT AS THAT OF THE PROGRAM OPERATED BY WARREN COUNTY, TENNESSEE.
